DOT Violations

DOT Sidewalk Violations in Queens

When a NYC DOT inspector finds an unsafe condition in front of a Queens property, the owner receives a Notice of Sidewalk Violation. Under NYC DOT rules, property owners, not the City, are responsible for installing, repairing and maintaining the sidewalk next to their property.

The 75 days start on the date shown on the certified mail receipt, or the date the notice was posted on the property. If the defects are not fixed in time, DOT may do the repair and bill the owner.

If a City tree damaged the sidewalk in front of a one-, two- or three-family home, the City does not issue a violation or charge the owner for that repair. Eligible homeowners can request an inspection through the Trees and Sidewalks program.
