Curb Cuts and Driveway Permits in NYC
A curb cut is the dip in the curb and sidewalk that lets a car reach a driveway or garage. Adding a new one, or making an existing one wider, is regulated work in New York City.
DOB requires a curb cut to sit at least 7 feet from street trees and fire hydrants, and the distance allowed from a neighboring driveway depends on the property’s zoning district.
A curb cut permit application is filed through DOB NOW: Build by a licensed Professional Engineer or Registered Architect, while the sidewalk and curb permits come from DOT’s Office of Construction Mitigation and Coordination. The finished curb has to follow DOT specifications. A new off-street parking space also has size rules: at least 8.5 by 18 feet, without extending onto the sidewalk.
